WARTAKOTALIVE.COM, JAKARTA – Perludem Executive Director Khoirunnisa Agustyati agrees that there was malpractice in the 2004 elections.

Nisa said this was reflected in the facts that occurred in the 2024 Election.

“I fully agree if it is said that there is electoral malpractice. I think so if we refer to several references,” said Nisa, who was present online at the Jaga Pemilu discussion, Monday (1/4/2024).

According to Nisa, election malpractice can be said to be an act of violation of election integrity.

“But what we are talking about today does not seem to be an accident. If it is an accident, it will probably be seen at the bottom, for example at the polling station, it is wrong to write or input,” she explained.

But if you look at what happened today, according to him there is something that is even broader in nature.

“Forms of Election Malpractice can be a form of violation or manipulation that can occur in terms of regulations, manipulation of voter choices, including in the administrative process or stages of the election,” said Nisa.

Then he mentioned that there were no significant changes in the regulations for organizing the 2024 elections, compared to the previous elections.

“If we look at the regulations, the Election Law this time is the same as 2019. There are no significant changes,” she explained.

But he said that changes actually appeared at a more technical regulatory level.

“For example, the General Election Commission Regulation (PKPU) is not revised at the nomination stage. We can include it in the Election Malpractice category,” he said.

It is known that DKPP has imposed a final hard warning sanction on KPU Chairman Hasyim Asy’ari, because he was proven to have violated the code of ethics regarding the presidential and vice presidential registration process after the Constitutional Court (MK).

According to DKPP, this is because the KPU processed Gibran’s registration as a vice president, without changing the minimum age requirement for presidential and vice presidential candidates in the rules.

Jokowi responds to the issue of social assistance to win Prabowo-Gibran

The trial of the dispute over the results of the 2024 presidential election is now rolling at the Constitutional Court (MK).

In the trial, the legal teams of the Anies-Cak Imin camp and the Ganjar-Mahfud camp said that President Jokowi was involved in the 2024 presidential election to win the Prabowo-Gibran candidate pair.

Jokowi was accused of utilizing power to perpetuate power through the Prabowo Subianto-Gibran Rakabuming Raka candidate pair (paslon).

Starting from pouring social assistance and mobilizing ministers, Jokowi was accused of doing so to win Prabowo-Gibran.

When asked about this, Jokowi responded by saying that he did not want to comment on the trial at the Constitutional Court.

Jokowi expressed this response when met at the inauguration of the opening of the XIIth HIKMAHBUDHI Congress in Ancol, Jakarta, Thursday (28/3/2024).

“I don’t want to comment on matters relating to the Constitutional Court, yes,” Jokowi said briefly, Thursday (3/28/2024).

Previously, Anies Baswedan-Muhaimin Iskandar’s legal team, Bambang Widjojanto, suspected that Jokowi had allowed his ministers to campaign to win candidate 02.

This was conveyed by Bambang in the preliminary examination session of the dispute over the general election results (PHPU) at the Constitutional Court building, Jakarta, Wednesday (3/27/2024).

Bambang stated that Jokowi had misused state facilities, in this case the State Intelligence Agency (BIN) to win Prabowo-Gibran.

“The question arises, in what capacity did President Joko Widodo use the BIN (State Intelligence Agency) to find out survey data and the direction of political parties. Is it as the head of government, a political actor, or affiliated with the interests of the candidate?” said Bambang.

Bambang also suspected that Jokowi had deployed ministers to help the Prabowo-Gibran campaign.

He then mentioned a number of ministerial names, including Coordinating Minister for the Economy Airlangga Hartarto, Coordinating Minister for Maritime Affairs and Investment Luhut Binsar Pandjaitan, and Investment Minister Bahlil Lahadalia.

According to him, these ministers have their own tasks to win Prabowo-Gibran.

“Minister Erick Thohir has never taken leave or resigned from his position as minister despite being proven to have carried out a series of campaigns,” he said.

“Minister of Religion Yaqut Cholil Qoumas who stated that he was ready to provide an additional 4 percent of votes for candidate pair number 02 Prabowo-Gibran, and briefed religious instructors throughout Indonesia,” Bambang added.

In addition, Bambang also mentioned the name of Agriculture Minister Amran Sulaiman who allegedly mobilized technical guidance to various regions to garner support.

The name of the Minister of Communications who is also the Chairman of Projo Budi Arie Setiadi was also mentioned in the trial.

“Deputy Minister of Agrarian Affairs Juli Antoni on his personal social media politicized the government program by distributing PTSL and waqf certificates to the community by giving congratulatory support to Prabowo-Gibran. Likewise with other officials,” he said.

Meanwhile, a member of the Prabowo Subianto-Gibran Rakabuming Raka presidential defense team, Fahri Bachmid, emphasized that Gibran’s candidacy in the 2024 presidential election was not on Jokowi’s orders.

Fahri said that the appointment of Gibran as Prabowo’s vice president was the result of an agreement between the general chairmen of the political parties supporting 02.

“The same thing happened in the process of Gibran’s nomination in the 2024 presidential election, the decision to nominate Gibran was not in the hands of President Jokowi but in the general chairmen of political parties which, when accumulated, obtained votes to fulfill PT 20 percent of the national legal vote,” said Fachri at the Constitutional Court hearing on Thursday.

After Prabowo-Gibran became a participant in the 2024 presidential election along with other participants, the KPU conducted voting throughout Indonesia.

Including overseas electoral regions.

There were a total of 823,220 polling stations (TPS) where voting was held on February 14, 2024.

As a result, Prabowo-Gibran received the majority with 96,214,691 votes.

According to Fachri, the process shows that there was no interference from President Jokowi because Prabowo-Gibran voters are all Indonesians.

“In this context, it is clear that President Jokowi has no authority in the nomination and election of Gibran in the 2020 regional elections and 2024 presidential elections which can lead to nepotism as narrated by the applicant,” he explained.
